These terms govern your use of the JumpStart community and website. By using the community and website, you acknowledge that you have read, understood and agreed to be bound by these terms and conditions.

The JumpStart Development Trust (“JumpStart” for short) is registered at 16 Lawley Avenue, Northcliff, 2195. Its website are hosted and managed in the Republic of South Africa. For the purpose of these terms, ‘our’, ‘we’ and/or ‘JumpStart’ will mean the JumpStart Development Trust and its related components, JumpSchools, JumpLabs and JumpCorp.

We may periodically change the terms, without notice, so please check them from time to time as your continued use of the website means you accept any changed terms.

INFORMATION

While we make every reasonable effort to ensure that the information provided on our website is accurate and current, you should not assume that the information provided is always current or that the website contains all the relevant information available.

YOUR COMMENTS

We value your comments, ideas, suggestions and feedback but JumpStart is not obliged to respond to, maintain or compensate you in any way whatsoever for your comments. Once submitted or offered, your comments become the property of JumpStart which will exclusively own all such rights, title and interests in the comments and will not be limited in any way in its use, commercial or otherwise, of any of the comments.

You warrant that the comments submitted by you to the website do not and will not violate any right of any third party, including copyright, trademark, privacy or any other personal or proprietary right. You agree not to submit or offer any comments that will be or will contain any defamatory, unlawful, abusive or obscene material. JumpStart disclaims any liability towards any third party regarding your comments and you shall remain accountable towards any third party regarding the contents of your comments.

CUSTOMER SERVICE

The transparency and integrity of our work is critical to our sponsors as well as to the efficiency of our programs for our beneficiaries. If you are unhappy with any part of the JumpStart service or have specific feedback, our customer service representatives are available to answer any questions you may have or respond to your feedback.

DONATIONS

These terms apply to any transaction between yourself and JumpStart which reserves, at all times, the right to amend these terms as it may see fit, and any such amendments shall be deemed to apply as between yourself and JumpStart.

To make donations through the website you must be over the age of 18.

You need not register with the site but may transact as a “guest” but it will be necessary to leave us a valid contact via email (at least) and or Cell number where we can follow up on your donation. We would, of course, like you to take the opportunity to register with us. If you do so you must provide certain information including personal details. You will be required to choose a password which you must keep secret at all times and you must enter your password each time you visit the website. JumpStart accepts no liability for any damages suffered or losses incurred from the use or misuse of your password.

Donations made by credit card are held for up to a maximum of three months before they are paid out to causes. This is a precautionary measure to avoid payment reversals, as banks allow credit card payments to be cancelled for 90 days after the date of the transaction. JumpStart will email details of the payments immediately after they have been made.

JumpStart may not be held responsible for any dissatisfaction you may feel regarding any donation made to a cause or project through the website. You may, of course, contact in the event of any such dissatisfaction and will endeavour to address your concerns.

INTELLECTUAL PROPERTY

JumpStart retains all copyright in all material, including logos and other graphics, which form part of its website unless otherwise already owned by partners (e.g. the Number Sense logo from Brombacher and Associates, Lumositry from LumoLabs, MathsBuddy etc. ). All data and information communicated to, or from, the website and/or any site information and database remain, and shall be, the sole property of the JumpStart.

JumpStart grants you permission to view, electronically copy and print in hard copy portions of the website for the sole purpose of browsing the website and supporting causes, or for your personal use only. Any other use of the information, graphics or materials on the website, including reproduction, modification, distribution or reproduction for purposes other than those indicated above and without the prior written consent of JumpStart and the lawful trademark and/or copyright owner (if applicable) is strictly prohibited and constitutes an unlawful infringement of the intellectual property rights of JumpStart and/or such trademark and/or copyright owner.

TRADEMARKS

‘JumpStart SA’, ‘The JumpStart Development Trust’, Think it Forward, and all other marks, logos and trade names appearing on these website are the property of JumpStart. Nothing contained on these website should be construed as JumpStart granting, by implication or otherwise, any license or right to use any of the trademarks displayed on the website without the express prior written consent of relevant JumpStart or other listed organisations. Your use of any of the trademarks displayed on the website is strictly prohibited.

You may not copy, reproduce, publish, upload, post, transmit, distribute or modify any logos or trademarks appearing on our website. You further undertake not to infringe any right of JumpStart in respect of such trademarks. The use of the trademarks on any other website or networked computer environment is prohibited. All rights not expressly granted are reserved.

ADVERTISING AND LINKS

External hyperlinks may be provided on the website. These links do not constitute any relationship between JumpStart and any third party or imply any endorsement by JumpStart of such a third party. The use of, or reliance upon, any external link provided is at your own risk.
Advertising and other promotional material will appear on the website from time to time. Such advertising or promotional material does not constitute any relationship between JumpStart and any third party placing such advertising or promotional material on the website. Nor does such placement imply any endorsement by JumpStart of the third party in questions. Once again, use of, or reliance upon, any such material is entirely at your own risk.

DISCLAIMERS AND EXCLUSIONS OF LIABILITY

You agree that use of the website or the Internet is entirely at your own risk. The website and their content are provided on an ‘as is’ and ‘as available’ basis and JumpStart makes no representations or warranties of any kind, whether express or implied, including, and without limitation, with respect to the website, their contents, the accuracy thereof, or any warranties or representations regarding the effectiveness of any security or encryption facilities or with regard to the availability of products and/or delivery arrangements and times.

JumpStart disclaims all representations and warranties, including but not limited to warranties as to the availability, accuracy or content of information, products or services, and warranties of merchantability or fitness for a particular purpose of information, goods or services.

JumpStart does not warrant that the functions provided by the website will be uninterrupted or error free, or that the website or the server that makes it available are free from viruses or other harmful components.

Save as expressly set out here, JumpStart shall under no circumstances whatsoever be liable to you as a result of or in connection with JumpStart’s negligent (including grossly negligent) acts or omissions or those of their employees, agents or designees or other persons for whom they may be liable in law, for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused (whether from contract, delict or otherwise and whether actually foreseen or reasonably foreseeable), sustained by you, or any other person arising from or as a result of any use in terms of this Agreement, the delivery, non-delivery, incorrect, erroneous or late delivery, the use, possession or consumption of the services as supplied through the website.

JumpStart, its directors, employees, designees, agents, representatives, affiliates and suppliers shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of or which may be attributable, directly or indirectly, to the use of or reliance upon their website (including any information contained thereon) or the Internet.

You will indemnify JumpStart and keep them fully indemnified from and against any loss or damage suffered or liability incurred, including without limitation in respect of any claim or demand by any third party by reason of any act or omission on your part or that of any family member, agent or representative acting on your behalf in connection with transactions concluded on the website and/or in terms of this Agreement and/or in relation to receipt of products or services supplied by JumpStart pursuant to any such order placed through the website or through any other means.

JumpStart’s liability, whether in contract or delict arising from any breach of any obligation in terms of this Agreement, negligence or otherwise shall not exceed at any time more than the monetary value of the order in respect of which any such dispute or claim arises.

GENERAL

The content contained on the website may be used by you for your own personal, non-commercial, information purposes. In using the website you agree not to infect it with any computer programming (such as a virus) that may damage, interfere with, delay or intercept any data or information on the website and you indemnify JumpStart for any damage caused by any such act attributable to you.
